‘Walking Dead’ Lawsuit: Millions Worth In Damages Due to Breach Of Contract Sought By Frank Darabont And CAA Against AMC

The Walking Dead Lawsuit has been going on for the past year or so. Frank Darabont, creator of Walking Dead, and CAA filed a legal complaint in the courts of the State of New York for wrongful termination. They later filed another complaint where AMC allegedly decreased Darabont's profit sharing without prior notice.

As reported by Deadline on the Walking Dead Lawsuit taking note of the original date of filing on December 17, 2013. Frank Darabont and CAA stated in their complaint that AMC terminated the services of Darabont "without cause, without notice, without explanation, and without any opportunity to cure."

This happened after the airing of the first season of The Walking Dead. Caa and Frank claims that a word "Instead" was replaced for the original word "Nonetheless" altered the whole agreement in the process. The amended complaint also contains the allegation that AMC executed its contractual 'pay or play' right as a viable reason to get rid of Darabont for the series.

Hollywood reporter adds that the Walking Dead creator is seeking approval from the New York Supreme Court Justice to amend his lawsuit. The amended complaint will add that AMC has unjustifiably lowered Darabont's Developed By Profit sharing to 7.5% from the original 10%. In addition, Darabont's EP/Showrunner profits to 1.875% from the original 2.5%. summing up of only a total of 75% profit participation.

Attorneys at Blank Rome and Kinsella Weitzman are the legal counsels of Frank Darabont and CAA. The amended complaint reads that "If plaintiffs prevail on the claim that Defendants' imputed license fee is improper and well below fair share market value, each individual percentage point is likely to be worth several million dollars,"

The recent amended complaint for the case filed by the lawyers of Frank Darabont and CAA against AMC Studios will surely have their hands full. The improper termination of Darabont and the lowering of his profits shares without due cause will definitely give Darabont and CAA tens of millions of dollars if they win this.
