Kelly Rutherford's custody battle for her kids, Helena and Hermes, have spiraled out of control now that she's left with nothing. However, aside from losing her kids to their father, she received the hardest dig a mother could take.
Rutherford, 46, reacted negatively to the judge's decision that her children have to return to her ex-husband Daniel Giersch after she spent five weeks with them. The "Gossip Girl" star claimed that the decision is "shocking, illegal, and abusive" to her children. The kids were sent back to their father last week after the judge ruled that they have to return to their father in Monaco, Daily Mail reports.
Reps of her Rutherford's ex-husband told TMZ that the kids were not "panicky" as she has previously claimed on August 11 when they met in court. "There was no scene. They were fine ... smiling broadly," the rep says.
The children were picked up by Giersch's mother in Manhattan, New York court, and the reps added that they went with their grandmother with no commotion or signs that they are missing their mother. "When they left the courtroom they were happy and showed no signs of missing their mother."
Hermes and Helena have been staying with their dad for three years now since Giersch had visa problems to visit the U.S. According to an arrangement settled by a California judge, 46-year-old Rutherford is the one to visit them in Monaco.
In the midst of Rutherford's custody battle, she got the chance to be with her kids in the U.S. for summer, with the condition that she'll return them on August 6. However, things turned for the worse when the actress failed to return her children to their dad on that day. She explained to People that it was hard for her to be away from her kids since it's the first time that she spent five weeks with them in six years since Helena was born.
"My goal is their well-being and that they're safe, happy, healthy kids. It's scary," she said. I don't want them to be fearful," she continued. "My children ask me all the time if I am still fighting for them .... I always tell them the day will never come when I say no."
Rutherford's custody battle continues as she is set to appear in Monaco court on Sept. 3. The actress remains firm and positive in fighting for her rights as a mother to get back her kids Helena and Hermes.
