The guy who allegedly attacked Lindsay Lohan over his cellphone pictures was arrested after incident at a Manhattan Hotel, on Sunday.
The Daily News reported that Lohan and Christian LaBella, 25, met at 10ak, a night club in Chelsea, Manhattan, where the actress invited him to join her and her friends back at the W Hotel.
The party came to an end when the actress found pictures of herself, from the previous party, on the accused cell phone.
"There is no question that Lindsay was assaulted," Lohan's spokesman, Steve Honig, told the Daily News.
"It's disheartening that not much is being done about it.
Labella, was reported by the Daily News to be "stunned" that he is facing charges for the incident.
"He doesn't really understand why this is happening," Peter Jessop, nephew of Labella told the Daily News.
"It's a shame when a celebrity like that can use her publicists to tar a kid who has done nothing wrong."
Jessop also denied that Labella attacked the actress when she tried to delete pictures of herself from his cellphone.
According to the Daily News, LaBella was initially charged with misdemeanor assault but the charges were dropped.
"Detectives determined that there wasn't enough to support LeBella's initial assault arrest, and instead cross complaints for harassment were filed," NYPD spokesman Paul Browne said.
"He was just out having fun, and Lindsay Lohan picked him out of a crowd at bar and said, 'You're coming with us.' I guess they had a friend in common," Jessop added.
"He didn't do anything to invite this."
